What it asksArrive in French with real farming intent and earn trust in a networked but somewhat tribal regen scene

Where the answer is not here

  • Buying agricultural land with no installation project a local structure can hold: Safer is told of every rural sale and can buy in place of the original purchaser.

How to arrive in Cévennes / Languedoc

Where arriving in a place would harm the community already there, the honest answer is not to go.

Every region in this tool is already someone’s home.

What living here asks of you

The Cevennes ask you to make peace with SAFER. SAFER holds pre-emption rights on nearly every agricultural sale and can step in as buyer to reassign land, so engaging the departemental office early with a credible installation project is the real work. Elevation governs everything: a parcel at 200 m and one at 1,000 m are two different climate regimes within 20 km, and the autumn cevenol storms can drop 300 to 600 mm in 24 hours, making flash-flood resilience and mid-slope placement a primary design constraint. The regen scene is deep and networked but somewhat tribal after 50 years of intentional-community life, and CAP access typically means incorporating a French association or GAEC and working in French.

What lawful entry involves, in order

Who may hold
No nationality restriction on buying rural land was found in the provisions opened; the control that applies to every buyer, French or foreign, is the Safer pre-emption right on sales of agricultural land and farm buildings. The Safer is informed of rural sales by notaries and may buy in place of the original buyer; the decree for each Safer fixes the zones and minimum parcel size where the right applies. Code rural et de la pêche maritime, arts. L143-1 and L143-7 (consolidated, in force; Safer page 'Le droit de préemption')
How a group can hold
Groupement foncier agricole (GFA)Terre de Liens (La Foncière)
First claim
  • The Safer of the region (Safer Occitanie for the Cévennes departments) holds a pre-emption right on sales of farm buildings and agricultural land in the zones set by its decree, and may offer a revised price; the right is used for objectives such as installing farmers, keeping family farms, fighting land speculation and protecting the environment, and is exercised only after the State's agreement (two government commissioners).
  • Sales to relatives and in-laws to the fourth degree, between co-heirs and certain farm workers, family helpers and partners are outside the Safer right (Code rural art. L143-4).
Direction
The consolidated Code rural shows Safer provisions amended by laws dated 26 May 2026 (art. L141-1) and 18 August 2026 (arts. L143-1 and L143-8); what those amendments changed was not compared, so no direction is asserted.direction not established
  1. Check the parcel against the commune's PLU zoning (A or N) and whether it lies in the park's core (cœur) or adhesion area before any offer.
Who decides: Mairie (urban planning office); Parc national des CévennesCode de l'urbanisme R151-22, R151-23; Parc national des Cévennes 'La réglementation du cœur'
  2. Expect the notary to inform the Safer of the sale and plan the project so that it answers the Safer's statutory objectives (installing or keeping farmers, a viable family farm, protecting the environment).
  3. If the Safer pre-empts and judges the price or conditions excessive, it sends the seller's notary a purchase offer on its own terms; the seller may accept, withdraw the property from sale or ask the court to review the price.
Who decides: Safer, the seller and the competent civil courtDuration: The seller who neither accepts, withdraws nor goes to court within six months of notification of the Safer's offer is deemed to have accepted it Code rural art. L143-10Code rural art. L143-10
  4. If the plan is to take control of a company that holds farmland rather than land directly, check whether the prior authorisation of the prefect applies once the significant-enlargement threshold is crossed.
Who decides: Préfet du départementCode rural art. L333-1 (law 2021-1756)
  5. Choose the holding body, for example a GFA among natural persons or a partnership with a Terre de Liens foncière, before the deed.
Who decides: The founding group; Terre de LiensCode rural art. L322-1; Terre de Liens
What the law rules out
  • Buying agricultural land does not guarantee the sale goes through to the buyer: the Safer can substitute itself as buyer, and sale price and conditions can be revised on its offer (Code rural arts. L143-1 and L143-10).
  • Inside the park's core, the core regulation applies to every user, whether owner, professional or visitor (decree 2009-1677, as described by the park).
Honest gaps
  • The content of the 2026 amendments to the Safer provisions (laws of 26 May 2026 and 18 August 2026) was not compared with the earlier text.
  • The two-month Safer decision period and the minimum parcel size for the Occitanie decree (dossier cites about 0.7 ha) were not found in an opened source and are not stated.
  • Residence routes and the right of a foreign buyer to live in France were not opened.
  • The park charter text and the core regulation's rules on works and construction were not read in detail; only the park's own summary pages were opened.
  • Association (loi 1901) and SCI forms named in the dossier were not opened.
  • Légifrance returned a bot-check page, so the Code rural and Code de l'urbanisme were read in the consolidated open-data mirror at codes.droit.org rather than on legifrance.gouv.fr.

Where legal and cost questions come first

These are the questions a community has to be able to answer in a place: who may hold the land, how a group can hold it together, and what it costs. Read them as context for a conversation with the people already there, not as a verdict on the place.

Legal and ownership

Foreign ownership

Where building is decided
In the agricultural (A) and natural and forest (N) zones of a municipal plan (PLU) only buildings needed for farming or forestry can be authorised, plus the extensions, annexes and changes of use the plan expressly allows; inside the Parc national des Cévennes the core zone has its own regulation, which was read only through the park's summary pages
First-claim holders

Key restriction
The Safer pre-emption right applies to sales of agricultural land in the zones fixed by its decree and is exercised only after the State's agreement; sales to relatives to the fourth degree, between co-heirs and a few other cases are exempt (Code rural L143-4). The dossier's 2-month decision period and 0.7 ha threshold were not found in an opened source and are not stated.

The centroid may fall on a regional hub city (Oaxaca City, Santiago, Bolzano, Taos, Evora) rather than a target rural settlement site, so a low number can reflect centroid placement more than real rural-settlement access.
