Where the answer is not here

  • Buying farmland as a non-farmer where the sale would shut a farmer out: the authority may refuse a sale that spreads farmland unhealthily (GrdstVG section 9), and for farmland of two hectares or more a non-profit settlement company then holds a pre-emption right (Reichssiedlungsgesetz section 4).

How to arrive in Saxony-Anhalt rural

Where arriving in a place would harm the community already there, the honest answer is not to go.

Every region in this tool is already someone’s home.

What living here asks of you

Saxony-Anhalt asks you to prove you intend to farm before it will sell you land. Germany sets no nationality bar, but the Grundstücksverkehrsgesetz lets the farmland authority refuse sales that would shut out a farmer who wants the land, and the Landgesellschaft holds a statutory pre-emption right on farmland of 2 ha and up, so community projects without an agricultural Nutzungskonzept routinely get blocked at the Landwirtschaftsbehörde, and the standard route is a German agricultural Genossenschaft or GmbH with a farmer-shareholder. Physically, this is one of Germany's driest regions, the Mitteldeutsches Trockengebiet, where you must design for long dry summers and real winter frost at once. The difficult part is social: rural Saxony-Anhalt has lost population continuously since 1990, and you will need German-language capacity and years of local-economic relationship-building before newcomers are trusted.

What lawful entry involves, in order

Who may hold
No nationality restriction on owning land was found in the federal provisions opened. The sale of an agricultural or forest plot, to anyone, needs the approval of the farmland authority, which may refuse or condition it only on specific grounds, among them an unhealthy distribution of land, an uneconomic reduction or division of holdings, or a grossly disproportionate price. The Länder may set a size below which no approval is needed; Saxony-Anhalt's threshold was not found. Grundstückverkehrsgesetz (GrdstVG) §§ 1, 2 and 9 (gesetze-im-internet.de)
How a group can hold
Eingetragene Genossenschaft (eG)Eingetragener Verein (e.V.)
  • Eingetragene Genossenschaft (eG). A society of open membership that promotes its members' economic, social or cultural interests through a joint business (Genossenschaftsgesetz § 1). Genossenschaftsgesetz (GenG) § 1
  • Eingetragener Verein (e.V.). An association whose purpose is not an economic business acquires legal capacity by entry in the register of associations (BGB § 21). Bürgerliches Gesetzbuch (BGB) § 21
First claim
The non-profit settlement company of the district holds a right of first refusal on a sale of agricultural land of two hectares or more when the sale needs approval under the GrdstVG and the farmland authority would have to refuse it under § 9; no such right applies to sales to public bodies, spouses, relatives to the third degree in the side line or in-laws to the second degree. A Land may raise the minimum size above two hectares (Reichssiedlungsgesetz § 4).
Direction
No change to the federal approval and pre-emption rules was found in the provisions opened; a Saxony-Anhalt agrarian-structure law was reported as pending and its status was not verified.stable · as of 2026
  1. Establish whether the plot is agricultural or forest land, or moor or waste land that could be brought into cultivation, because only then does the GrdstVG approval regime apply.
Who decides: Land register and the farmland authority (Genehmigungsbehörde)Grundstückverkehrsgesetz § 1
  2. Have the sale contract approved: the authority may refuse or condition approval only on the grounds listed in § 9, so a buyer's land-use concept should address distribution of land, viability of holdings and price.
Who decides: Farmland authority (Genehmigungsbehörde)Duration: The decision is due within one month of the application and the contract; an interim notice extends this to two months, or three where the pre-emption declaration must be obtained, and approval is deemed given if no decision is served in time Grundstückverkehrsgesetz § 6(1) and (2)Grundstückverkehrsgesetz §§ 2 and 9
  3. For plots of two hectares or more, expect the settlement company's right of first refusal to be checked where approval would otherwise be refused.
Who decides: Gemeinnütziges Siedlungsunternehmen of the districtReichssiedlungsgesetz § 4(1)
  4. Before buying for a dwelling in open countryside, check whether any privileged use under § 35(1) BauGB can carry the project, since other building there is the exception.
Who decides: Municipality and local building authorityBaugesetzbuch § 35(1)
  5. Choose the holding body for the group, such as a co-operative or a registered association, before the contract.
Who decides: The founding groupGenossenschaftsgesetz § 1; BGB § 21
What the law rules out
  • The farmland authority's power to refuse is limited to the grounds in § 9 GrdstVG; where the plot is sold for non-agricultural purposes the price ground may not be used (§ 9(4)).
  • A sale of agricultural land can be blocked or conditioned where it would mean an unhealthy distribution of land, so approval is not automatic for a buyer with no farming role (GrdstVG § 9(1) and (2)).
Honest gaps
  • A Saxony-Anhalt Agrarstrukturgesetz was reported in 2026 research as pending; its enactment status was not verified and no rule is taken from it.
  • The Saxony-Anhalt size threshold below which no GrdstVG approval is needed (GrdstVG § 2(3)) was not found, and the dossier's 'about 1 ha' is not repeated.
  • Which body is the designated settlement company for Saxony-Anhalt under the Reichssiedlungsgesetz was not confirmed; the Landgesellschaft Sachsen-Anhalt describes itself as acting for the Land on rural structure but its page does not name the pre-emption right.
  • The BVVG wind-down date from the dossier (sales 2024-2030) could not be confirmed and is not stated.
  • Residence routes and the right of a foreign buyer to live in Germany were not opened.
  • The remaining paragraphs of § 35 BauGB (non-privileged projects) and Saxony-Anhalt's building code were not read.

Where legal and cost questions come first

These are the questions a community has to be able to answer in a place: who may hold the land, how a group can hold it together, and what it costs. Read them as context for a conversation with the people already there, not as a verdict on the place.

Legal and ownership

Foreign ownership
allowed No nationality restriction on owning land was found in the federal provisions opened. The sale of an agricultural or forest plot, to anyone, needs the approval of the farmland authority, which may refuse or condition it only on specific grounds (among them an unhealthy distribution of land, an uneconomic reduction or division of holdings, or a grossly disproportionate price; GrdstVG section 9). The Länder may set a size below which no approval is needed; Saxony-Anhalt's threshold was not found, so the dossier's 'about 1 ha' is not repeated.
Collective ownership path
Eingetragene Genossenschaft (eG) or Eingetragener Verein (e.V.); the farmer-shareholder GmbH route named by the dossier was not opened
Several households on one holding
not as of right
Residency needed to buy
no residency required
Where building is decided
In open countryside (Außenbereich) a project is permissible only if public interests do not stand against it, access is secured and it falls in a privileged category, such as serving a farm or forestry business and taking up only a subordinate part of the holding's land (Baugesetzbuch section 35); other projects are decided case by case
First-claim holders
The non-profit settlement company of the district (Reichssiedlungsgesetz section 4: farmland of two hectares or more, when the sale needs approval under the GrdstVG and the authority would have to refuse it; a Land may raise the minimum size)
Key restriction
The farmland authority can refuse a sale on the grounds in GrdstVG section 9, for example an unhealthy distribution of land, so approval is not automatic for any buyer.
