Whose landMontagne limousine villages and hamlets

Plateau de Millevaches (Limousin)

FranceMontagne limousine: the granite plateau of the western Massif Central

Granite headwaters of the Vienne, Creuse and Vézère: wet moor, peat bog and post-war conifer plantation between 300 and 1,000 m, held together for fifty years by village associations, cooperatives and welcoming mairies. A plateau to arrive in through a local structure, not a parcel; the forest itself has been contested for forty years.

Land standing · qualitative, never scored

Montagne limousine villages and hamlets: farming and forestry families, returning natives, and five decades of newcomers who helped build the associations, cooperatives and municipal welcome that slowed the decline; hamlet commons (sections de commune) still exist

TenureFreehold, but rural sales are notified to the Safer (Nouvelle-Aquitaine, with offices for Corrèze, Creuse and Haute-Vienne), which can pre-empt farmland and re-allocate it to another buyer; woods under 4 ha carry neighbour and commune rights of first refusal; hamlet-common land is owned by the section de commune and managed by the municipal council
Sources for this row (1)
Arriving in good faithArrive with a project a local structure can hold: bring the idea to the mairie (Faux-la-Montagne, for one, publicly invites newcomers to present a project and connects them to local associations), take a farm lease through Terre de Liens and Objectif Terres or the installation support of ADEAR Limousin, or become a member of L'Arban, the plateau's housing and planning cooperative. Not there for a lone buyer of an isolated parcel with no local structure behind them
Sources for this row (2)
What it asksWork in French, take part in municipal and associative life, and accept the documented friction rather than argue it away: research records returning natives and environment-minded newcomers pulling in different directions, sharply so in the 2014 municipal elections, and the forest has been contested for more than forty years

Where the answer is not here

  • Buying an isolated parcel as a lone buyer with no local structure behind the project: rural sales are notified to the Safer, which can buy farmland in place of the buyer, and the commune of Faux-la-Montagne asks newcomers to bring their project to the town hall first.

How to arrive in Plateau de Millevaches (Limousin)

Where arriving in a place would harm the community already there, the honest answer is not to go.

Every region in this tool is already someone’s home.

What living here asks of you

Millevaches asks you to arrive through a structure, not a parcel. The plateau is thinly peopled, about 12 inhabitants per km2 across the Parc, and was held together from the 1970s by village associations and mayors who made newcomers welcome; in the Parc's own count, migration only just offsets natural decline. Land here is not simply an open market: the Safer can pre-empt rural sales, communes and neighbours hold first refusal on small woods, and farmland in hamlet commons goes first to farmers who already live and work there. The ground is wet moorland, peat and forest between 300 and 1,000 m with hard winters, roughly half the Parc wooded, much of it twentieth-century conifer planting that people have protested for over forty years. Researchers have named the arrival of better-resourced, environment-seeking newcomers rural gentrification and recorded sharp newcomer-versus-native polarisation in the 2014 municipal elections. French, and a seat in municipal or associative life, are the price of standing.

What lawful entry involves, in order

Who may hold
No nationality condition appears in the Code rural provisions opened (Safer pre-emption L143-1 and following, the agricultural land group L322-1, the farming group L323-1): pre-emption depends on the kind of land and the sale, not on the buyer's passport. No notarial statement on foreign buyers could be opened, so a notary should confirm. Code rural et de la pêche maritime, L143-1, L322-1, L323-1 (consolidated text, codes.droit.org mirror of Légifrance, last update 2026-10-01)
How a group can hold
Groupement foncier agricole (GFA)Groupement agricole d'exploitation en commun (GAEC)Terre de Liens (Limousin)Section de commune (hamlet commons)
  • Groupement foncier agricole (GFA). A civil company formed between natural persons to hold farmland together; the death, bankruptcy or liquidation of one partner does not end it. Code rural et de la pêche maritime L322-1
  • Groupement agricole d'exploitation en commun (GAEC). A civil company of persons formed between adult natural persons for farming in common. Code rural et de la pêche maritime L323-1
  • Terre de Liens (Limousin). The association buys farms with citizen savings so that farmers who do not wish to be, or cannot be, owners can settle, for organic farming projects, and says there are 8 Terre de Liens farms in Limousin. It also guides project holders and sellers through the Objectif Terres site. The figure is for the whole of Limousin, not the plateau. Terre de Liens Limousin
  • Section de commune (hamlet commons). A part of a commune that holds property or rights of its own, as a public-law legal person; its members are the inhabitants with real and fixed domicile on its territory, the council and mayor manage it, and none can be created since the law of 27 May 2013. Its agricultural and pastoral land goes by lease or grazing agreement first to farmers domiciled and installed on the section. A newcomer joins its rules, not buys its land. Code général des collectivités territoriales L2411-1, L2411-2 and L2411-10
First claim
  • The Safer (the regional land-development and rural-establishment society) has a pre-emption right on sales of buildings for agricultural use and bare land of agricultural vocation, including, where there is no urbanism document, land in the not-yet-urbanised parts of the commune, woods and forests excluded; it buys in place of the buyer and resells to another person whose project fits local needs better (Code rural L143-1; Safer). Its conditions and minimum surface are fixed by decree for each Safer (L143-7); the Safer Nouvelle-Aquitaine serves Creuse, Corrèze and Haute-Vienne.
  • Sales to relatives or in-laws to the fourth degree, to co-heirs, and between co-owners are exempt from Safer pre-emption (Code rural L143-4).
  • On a sale of woodland of under 4 hectares, the owners of a contiguous wooded parcel hold a right of preference, and the commune holds a right of preference or, where it owns a contiguous parcel under a management document, a pre-emption right, with two months for the mayor to answer after notification; a sale made in breach of the owners' right is void (Code forestier L331-19 to L331-24).
  • Farmland owned by a section de commune is let first to farmers with domicile, farm building and seat on the section, then to farmers of the commune (Code général des collectivités territoriales L2411-10).
Direction
Since the law of 23 December 2021 the Safer must be informed of transfers of shares in land-holding companies, and taking control of a company holding agricultural land above a regional significant-enlargement threshold needs the prefect's prior authorisation (Code rural L141-1-1, L333-2); the text of L141-1-1 was last amended on 19 August 2026.tightening · as of 2026
  1. Begin with the commune and the people already working the land, not a parcel. Faux-la-Montagne's own page says welcoming new residents is at the heart of its concerns, invites a would-be newcomer to bring an idea or project to the town hall, and promises to connect them with people, associations or bodies that can support it. Terre de Liens Limousin and the Objectif Terres platform guide project holders and sellers of farmland. The framework's own answer for a lone buyer of an isolated parcel with no local structure behind it is not there.
Who decides: The commune (mairie); Terre de Liens Limousin; local associationsFaux-la-Montagne, Nouveaux arrivants; Terre de Liens Limousin
  2. If farmland is in view, look at a lease before a purchase: Terre de Liens buys farms with citizen savings and leases them to farmers who cannot or do not wish to own, and Objectif Terres lists farms for lease and sale from Terre de Liens and its partners.
Who decides: Terre de Liens Limousin; Objectif TerresTerre de Liens Limousin
  3. Before an offer on farmland, buildings with agricultural use or non-urbanised land, expect the notary to inform the Safer, which can buy in place of the buyer and resell to another person; the surface above which it applies is set by decree for each Safer and was not looked up here.
Who decides: Notary; Safer Nouvelle-Aquitaine (departmental services for Creuse, Corrèze and Haute-Vienne)Safer, Le droit de préemption; Code rural L143-1, L143-4, L143-7, L143-8
  4. Ask the commune which urbanism document applies, since without one only the already urbanised parts of the commune are buildable, and check that a plan is compatible with the Parc charter.
    Who decides: Commune; intercommunality (for a PLUi)Code de l'urbanisme L111-3; Code de l'environnement L333-1
  5. If woodland of under 4 hectares is part of the offer, expect notification to the owners of contiguous wooded parcels and to the mayor, who have two months to answer.
Who decides: Seller, via the notary; owners of contiguous parcels; the mayorDuration: The mayor has two months from notification to say whether the commune exercises its right Code forestier L331-22 and L331-24Code forestier L331-19, L331-22 and L331-24
  6. Ask the commune whether the land belongs to a section de commune: if so it is not the seller's to sell, and its farmland is let first to farmers installed there.
Who decides: Commune (council and mayor manage sectional property)Code général des collectivités territoriales L2411-1, L2411-2 and L2411-10
  7. For a group that will farm together, choose the holding body before the deed: a GFA to hold land, a GAEC to farm in common, or a lease through Terre de Liens.
Who decides: The founding groupCode rural L322-1 and L323-1
What the law rules out
  • No new section de commune can be created since the law of 27 May 2013, and sectional property is held by the section, a public-law legal person, not by a private seller (Code général des collectivités territoriales L2411-1).
  • A sale of woodland of under 4 hectares made without notifying the owners of contiguous wooded parcels is void, and an action can be brought for five years (Code forestier L331-20).
  • A Safer can pre-empt a sale of agricultural land and resell it to another person; being the first buyer does not decide who ends up with the land (Code rural L143-1 and Safer).
Honest gaps
  • The surface threshold and conditions of Safer pre-emption for Nouvelle-Aquitaine are set by decree and were not opened; no threshold from another Safer (for example the Cévennes 0.7 hectares) is carried over.
  • Légifrance returns HTTP 403 to every scripted request, so the consolidated codes were read through the codes.droit.org mirror (consolidated texts built from the Légifrance data; Code rural updated 2026-10-01, Code forestier 2026-08-20), not on Légifrance itself.
  • Which of the 124 communes have a PLU, a PLUi or a carte communale was not checked in this run, so how much of the park is buildable under the national rule is unknown.
  • Which communes still have sections de commune was not looked up; the Faux-la-Montagne sectional forest is the only case in the dossier.
  • No notarial or official statement on foreign buyers could be opened; the open status rests on the absence of any nationality condition in the provisions read.
  • The L'Arban housing cooperative named in the pre-selection could not be sourced and is left out.
  • Whether buying carries any right to a residence permit was not opened.
None is shown.

Where legal and cost questions come first

These are the questions a community has to be able to answer in a place: who may hold the land, how a group can hold it together, and what it costs. Read them as context for a conversation with the people already there, not as a verdict on the place.

Legal and ownership

Foreign ownership
allowed No nationality condition appears in the Code rural provisions opened (SAFER pre-emption L143-1 et seq.; GFA L322-1; GAEC L323-1): pre-emption turns on the kind of land and the sale, not on the buyer's passport. A dedicated notarial statement could not be opened (notaires.fr returned 403), so confirm with a notaire.
Collective ownership path
GFA (groupement foncier agricole, a civil company between natural persons, Code rural L322-1) for farmland held together; GAEC (L323-1) for joint farming; a SCIC cooperative (L'Arban uses one for housing); an association loi 1901; or a lease from a Terre de Liens foncière, which buys farms with citizen savings and leases them to farmers who cannot or do not wish to own. The Safer must be informed of transfers of shares in land-holding companies (L141-1-1).
Several households on one holding
with conditions
Residency needed to buy
no residency required
Where building is decided
Permis de construire under the local urbanism document. Of the 124 communes, 52 are covered by a PLUi, 8 by a PLU, 1 by a carte communale and 59 have none, so only already urbanised parts are buildable (Code de l'urbanisme L111-3); 4 are not flagged as national-rule communes but no published document was found at the sampled point (Géoportail de l'Urbanisme via API Carto, queried 2026-10-04). Local documents must be compatible with the Parc charter 2018–2033 (Code de l'environnement L333-1).
First-claim holders
Safer Nouvelle-Aquitaine (agricultural and non-built rural land; threshold fixed by decree); Owners of contiguous woods and the commune (woods under 4 ha, Code forestier L331-19 et seq.); Residents of a section de commune, then farmers of the commune, for sectional farmland (CGCT L2411-10)
Key restriction
The Safer Nouvelle-Aquitaine can pre-empt a sale of agricultural or non-built rural land (outside any urbanism document, any non-urbanised land except woods) and resell it to another buyer; the surface threshold is fixed by decree per Safer (L143-7) and was not looked up here. Sectional land belongs to the section de commune, not to a private seller, and no new section can be created since 2013 (CGCT L2411-1).
Legal direction
tightening Since the 2021 law the Safer is informed of share transfers of land-holding companies and large takeovers need prefectoral authorisation (Code rural L141-1-1, L333-1 to L333-3, in force 2021-12-24; L141-1-1 text last amended 2026-08-19).

Known gaps. Safer Nouvelle-Aquitaine decree text and surface threshold not opened; Légifrance returns 403 to bots, so the codes were read through the codes.droit.org mirror of the consolidated text (last update 2026-10-01); sections de commune confirmed for one commune only; urbanism counts are a snapshot of what the Géoportail publishes, not a legal opinion.

Water source control

Rights regime
Owner of land where a spring rises may use it, subject to downstream rights (Code civil 641); withdrawals up to 1,000 m3 a year count as domestic use (Code de l'environnement R214-5); communes are competent for drinking-water distribution (CGCT L2224-7-1); the prefect can limit or suspend uses in drought (Code de l'environnement L211-3).
